Use or Purchase of Product

Use of this website or the purchase of product from MMR/Modular Motorsports Inc. hereby constitutes a agreement in which customer understands and agrees to the terms and conditions set forth below:

 

 

Published/Internet pricing:

Modular Mustang Racing cannot anticipate price increases which manufacturers impose throughout the year, leading to increased pricing. Due to print lead times, all retail prices are subject to change without prior notice. Product specification/appearance, availability and pricing are all subject to change without notice.

 

Credit Card purchases:
In order to protect our customers and Modular Mustang Racing against credit card fraud, all credit card purchases are verified. MMR will pursue Civil and Criminal action to recover ALL costs of credit card misuse (such as chargebacks on shipped and received items) and fraud. When shipping to an address other than the billing address a signed request is required.

 

Order Cancellations/Returns:
NO RETURNS ON INTERNATIONAL or CANADIAN orders. Select items can be returned within 7 days for refund, if in unused unopened condition with all original packaging, there is a 25% re-stocking fee, all items will be inspected for damage. NO RETURNS ON USED/INSTALLED ITEMS. NO returns on special/custom orders (transmissions, engines, racing components, rotating assemblies, fuel systems, electrical components.). Order Cancellations whether the item has shipped or not are subject to a 25% cancellation fee-this is to recover employee costs and credit card fees. ALL CANCELLATIONS MUST BE SUBMITTED IN WRITING,  SHIPPING IS NON REFUNDABLE. ALL returns require a return authorization number to be written on the package. You may receive your RA# by contacting our return office at info@modularmustangracing.com RA#'s will not be issued by phone, payments will only be refunded in the way they are received. ALL Returns sent without RA# will be refused. NO RETURNS AFTER 7 DAYS-no exceptions. Modular Mustang Racing is not responsible for any installation/labor charges on products which are damaged, defective, or ordered/shipped in error. Items damaged in shipping are NOT the responsibility of MMR and must be taken up with the carrier, MMR is not responsible for delays in shipping. Due dates given for items/ labor, and installs are estimates. Backorders and workload can affect these completion/ship dates and MMR is in no way responsible for late/backordered items/labor. Any items that have been disassembled or modified cannot be returned. MMR is not responsible for any "down time", storage fees, rental cars, shop fees or other fees associated with a defective product or a product shipped in error. Products shipped in error will be replaced with the correct product-refunds will be subject to the normal restocking fee. Layaways left over 1 year without payment are forfeited to recover storage and employee costs. Defective items cannot be returned for a refund, they will be repaired or replaced at MMR's option.

 

Pollution Controlled vehicles and components:
Many products listed here are dedicated racing items and are not intended for street use in emission controlled vehicles. Unless otherwise stated, these parts are not to be installed in vehicles subject to emission control regulations. Check with your state emission authorities before installation of any parts listed here which do not carry an emissions compliance. Modular Mustang Racing makes no warranties or guarantees, express or implied, as to the emission law compliance of any of its customers’ vehicles.

 

Items/parts Left at MMR Facility

 Engines, parts, or orders left/forgotten at our facility for service, warranty or repair over 30 days will be considered abandoned. If no contact has been made within 30 days these parts will be disposed of or sold at our discretion to recover storage space/fees. NO REFUNDS, PAYMENTS OR REPLACEMENTS WILL BE ISSUED! Please take your old parts when you leave!!

 

Warranties:
All Products sold by Modular Mustang Racing are covered by the manufacturer's own terms of warranty. Modular Mustang Racing is not responsible for products sold which are not covered by a manufacturer's warranty. Some vendors, such as Ford Motorsport Racing, do not offer any form of warranty on their products. For warranty information on specific Manufacturers contact the Manufacturer directly.

 

MMR Shortblock/Longblock Warranty:

Effective 01/04, All MMR Racing shortblocks are covered by a 1 year warranty against defects in workmanship, this is determined solely by MMR, this time period starts when the engine is received by the customer.  This warranty will cover ENGINE dis-assembly/assembly. Warranty is VOID on ANY engine that has been disassembled, tampered with or otherwise modified by ANY business or person unless authorized by MMR.  This warranty does not cover neglect, mis-installation, mis-use, improper tuning or damage caused by other part failures, failure to comply with this policy  releases MMR from ALL warranty obligations . MMR is not responsible for any "down time", storage fees, rental cars, shop fees or other fees associated with a warranty claim regardless of the cause of failure. Customer is responsible financially for removing the engine and shipping to and from MMR for service or warranty consideration/repair regardless of cause of failure. Because MMR does not manufacture the parts contained within these shortblocks we cannot provide a warranty for them, the individual manufacturers of these internal parts may  have warranties, because they change from time to time it is best that the customer contact these companies for up to date information. Warranty is only valid to original owner. Service records required showing proper maintenance.

Extended Warranty:

When the extended warranty option has been purchased the warranty is extended from the above 1 year to an additional 6 months for a total of 1 year and 6 months (1 1/2 years). This warranty also covers transportation by MMR's carrier to and from MMR. All other Terms and conditions are same as std warranty.

DISPUTES:
These Terms and Conditions will be governed by and construed under the laws of the State of California, excluding only its conflict of law provisions. Customer hereby submits to the exclusive jurisdiction of the courts within the State of California, and waives any jurisdictional venue or inconvenient forum objections to such courts.
Any failure by Modular Motorsports Inc. to enforce any of its rights under these Terms & Conditions, or any applicable laws, shall not constitute a waiver of such right.

 

Layaways

   Terms and conditions:

   Layaways are non refundable- no exceptions!

   No Cancellations or Refunds on Layaway products or engines

   Orders ship after balance is paid in full (allow 2-3 weeks for engines or custom items)

  Maximum lay away term is 12 months, layaways are free of charge for a 12 month period. Layaways that exceed 12 months will be subject to a monthly charge of  $50, layaways that exceed 18       months will be subject to a monthly charge of $100. Orders/layaways without any payment activity within a 12 month and 1 day period will be considered abandoned and no refunds will be given. No exceptions!

  Upgrades/additions are allowed (down grades not allowed)
